Terms of Service

1. Adults only (18+)

HookupAI contains sexually explicit material and adult listings. You must be at least 18 years old, and of the age of majority where you live, to access any part of it. By using HookupAI you confirm that you are an adult, that viewing adult material is lawful where you are, and that you will not allow any minor to access the service through your device or account.

We may ask any user to verify their age at any time. Advertisers, models, agencies and creators must complete identity and age verification before any profile or content is published (see our Age & Records Statement).

2. What the service is

HookupAI is an online platform that provides:

• Listings — profiles published by independent adult advertisers and agencies, with tools to message them and request bookings.
• AI companions — fictional, computer-generated characters you can chat with (see section 6).
• Wallet, subscriptions and paid features — prepaid balance and plans used to pay for platform features (see section 7).

We are an intermediary. Advertisers are independent: they are not our employees, agents or partners, and we do not arrange, supervise, or take part in any meeting between users. Any arrangement you make with an advertiser is between you and that advertiser. Verification badges reflect only the specific checks described on the profile; they are not an endorsement or a guarantee of anyone's conduct.

In-person listings, advertiser profiles and booking features are available only to visitors located in the markets where we currently operate (currently Kenya); visitors elsewhere are shown a “not available in your region” notice. AI companions are available in other countries, subject to the 18+ requirement and local law. We determine location from network information and may restrict access accordingly; do not use tools to misrepresent your location.

3. Your account

• Provide accurate information and keep it up to date. One person, one account.
• Keep your credentials and any two-factor device secure. You are responsible for activity on your account.
• Do not sell, transfer, or let anyone else use your account.
• Tell us promptly through the contact form if you suspect unauthorised use.

4. Prohibited content and conduct

You must not use HookupAI to do, attempt, facilitate or advertise any of the following. The Acceptable Use Policy gives more detail and forms part of these Terms.

• Anything involving a minor — any depiction, description, role-play or solicitation involving a person under 18, or a person who appears to be under 18. We report suspected child sexual abuse material to the relevant authorities.
• Trafficking, coercion or exploitation — advertising or arranging services for another person who is not acting freely, third-party control of an advertiser's earnings or communications, or any form of forced labour.
• Non-consensual content — intimate images or video of anyone who has not given documented consent to its creation and publication, hidden-camera material, “revenge” content, or sexualised deepfakes of real people.
• Solicitation of illegal acts — offering, requesting or arranging any act that is unlawful where it would take place, including unprotected or unsafe practices that endanger health, and the sale of drugs or weapons.
• Violence, threats, harassment, stalking, doxxing or hate speech.
• Impersonation, fake profiles, stolen photos, or misleading verification claims.
• Fraud, scams, advance-fee schemes, chargeback abuse or money laundering.
• Scraping, automated access, security testing without written permission, or interfering with the service.

Advertisers are solely responsible for complying with the law where they operate. Laws on adult services differ by country and county. Publishing a listing does not mean we have confirmed that any service described is lawful. You must not offer or provide any service that is unlawful where it is provided.

5. Advertiser, agency and creator obligations

If you publish a profile, photos, video or other content, you warrant and agree that:

• Age: you and every person shown in or referenced by your content were 18 or older when the content was created, and you can prove it with government-issued identification.
• Identity and consent: you are the person in the profile (or, for an agency, you hold the verified, documented, freely given and revocable consent of each person you represent), and every person depicted consented to the content being created and published on HookupAI. You sign our content provider agreement before uploading, and anyone else shown signs a release from their own verified account; we keep these consent records and stop showing media as soon as the consent behind it is withdrawn (see your Consent page).
• Image rights: you own or are licensed to use all content you upload, and it does not infringe anyone's copyright, privacy, image or personality rights.
• Accuracy: your photos are recent and of you, and your rates, availability and services are described truthfully.
• Legality: you comply with all laws that apply to you, including tax, health and public-order laws.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, blur, watermark and display your content for the purpose of operating and promoting your listing on HookupAI. The licence ends when you delete the content or your account, except for copies we must keep for legal, safety or record-keeping reasons.

You will indemnify us against claims, losses and costs arising from your content, your breach of these warranties, or your dealings with other users, to the extent permitted by law.

6. AI companions

• AI companions are fictional characters generated by artificial intelligence. They are not real people, do not represent any real person, and no human is reading or writing their replies in real time.
• Images, voice and text produced by AI companions are synthetic. Any resemblance to a real person is coincidental. You must not try to make an AI companion depict a real, identifiable person, a minor, or any content prohibited by section 4.
• AI-generated images, voice notes and videos are marked as AI-generated: they carry C2PA content credentials stating they were made by AI, images also carry an invisible watermark, and videos show a visible “AI Generated” label. You must not remove or alter these marks or present the media as a real photo, recording or person.
• A companion voice made from a real person's recordings is used only with that person's recorded, identity-verified consent, only for the characters they chose, and stops as soon as they withdraw it from their Consent page.
• AI output can be wrong, inconsistent or inappropriate. It is entertainment, not advice (medical, legal, financial, emotional or otherwise). If you are in crisis, contact local emergency services. When a message suggests a risk of suicide or self-harm, companions step out of character and show crisis resources, as described in our crisis protocol.
• Conversations are processed by our AI sub-processors to generate replies and are moderated for safety, as described in our Privacy Policy.
• Message, media and call allowances are consumed as shown in the product before you confirm.

7. Wallet, subscriptions and payments

• Prices are shown in KES (or the currency displayed at checkout) and include any taxes we are required to collect unless stated otherwise.
• Payments are processed by third-party providers (for example M-PESA, card processors and, where offered, cryptocurrency processors). Their terms also apply.
• Wallet balance is prepaid credit for use on HookupAI. It is not a bank deposit, does not earn interest, and cannot be withdrawn as cash by clients.
• Subscriptions renew automatically at the end of each period until cancelled. Cancelling stops the next renewal; paid access continues until the end of the current period.
• Booking holds, cancellation outcomes and the circumstances in which amounts are returned to your wallet are set out in our Payments & Refund Policy. There are no discretionary cash refunds.
• Advertiser earnings are paid out subject to verification, applicable commission, and anti-fraud checks. We may hold funds connected to suspected fraud, chargebacks or a breach of these Terms while we investigate.

8. Moderation, reporting and removal

We review content using automated tools and human moderators and may remove, blur or restrict any content or account at our discretion where we believe it breaches these Terms or the law. Anyone — including people without an account — can ask us to remove content through our content removal process. Reports involving a possible minor or non-consensual content are treated as urgent.

9. Suspension and termination

You may close your account at any time from your account settings. We may suspend or terminate your account, remove your content, or withhold access to features immediately if you breach these Terms, if we are required to by law, or if we reasonably believe your use creates risk for other users or for us. Where the law allows, we will tell you the reason. Remaining client wallet balance on an account terminated for a serious breach (such as fraud, exploitation or content involving minors) may be forfeited or retained pending any investigation by authorities. Sections that by their nature should survive termination (including 5, 10, 11 and 12) survive.

Appeals. You can appeal any suspension, ban, listing suspension, media rejection, identity-verification rejection, chat block or warning from your Appeals page; if you cannot sign in, use the account appeal form. A person who did not make the original decision where possible reviews each appeal, we aim to reply within 7 days, and we tell you the outcome and the reason. If we accept your appeal, we reverse the decision.

10. Disclaimers and limitation of liability

The service is provided “as is” and “as available”. To the fullest extent permitted by law we exclude implied warranties and are not liable for the acts, omissions, content or services of advertisers or other users, or for indirect or consequential loss. Our total liability to you for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, including under the Consumer Protection Act, 2012.

11. Governing law and disputes

These Terms are governed by the Laws of Kenya. The courts of Nairobi, Kenya have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the service, without prejudice to any mandatory consumer rights you have where you live. Before starting proceedings, please contact us so we can try to resolve the issue.

12. Changes to these Terms

We may update these Terms. We will show the new “last updated” date and, for material changes, give notice in the product or by email before they take effect. Continuing to use HookupAI after that means you accept the updated Terms.
